SUNNY Act clears both chambers

New York's legislature passed the Solar Up Now New York (SUNNY) Act (A.9111C/S.8512C) in late May 2026, bringing plug-in solar one step closer to law. The bill would allow devices with up to 1,200 watts of AC output and would take effect immediately if signed by Gov. Kathy Hochul.

What the SUNNY Act does

The measure exempts qualifying plug-in solar devices from utility oversight, giving millions of apartment and balcony dwellers a straightforward way to generate their own power.

An important gap

As passed, the bill does not include explicit language protecting a resident's right to use a device over the objections of a landlord or HOA — a limitation worth understanding if you rent. The bill now sits on the governor's desk awaiting her signature.
